Terms of service

These Terms of Service (“Terms”) govern your access to and use of sonviastudio.com and your purchase of products from SonviaStudio.

The Site is operated by Septitri LLC, doing business as SonviaStudio. Throughout these Terms, “SonviaStudio,” “we,” “us,” and “our” refer to Septitri LLC.

By accessing the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy, Return and Refund Policy, Shipping Policy, and other policies posted on the Site.

If you do not agree, do not use the Site.

1. Eligibility

You must be legally capable of entering into a binding contract in your jurisdiction to make a purchase.

If you use the Site on behalf of a company, organization, or another person, you represent that you have authority to bind that party to these Terms.

2. Online Store

Our store is hosted by Shopify, which provides the ecommerce platform used to present and sell our products.

We may modify, suspend, or discontinue any part of the Site or its features at any time, subject to applicable law.

3. Products

SonviaStudio sells hand-painted, personalized, and made-to-order glassware and ceramic products, including champagne flutes, mugs, plates, bowls, and related gifts.

We make reasonable efforts to display product images, descriptions, dimensions, and colors accurately. However:

  • Colors may vary between screens and lighting conditions;
  • Handmade brushwork and design placement may vary slightly;
  • Product dimensions and capacity may have minor tolerances;
  • Natural or production-related variations may occur in glass and ceramics.

These reasonable handmade variations are part of the character of the product and are not defects.

4. Personalization

You are responsible for ensuring that all personalization information is complete and accurate, including:

  • Names;
  • Initials;
  • Titles;
  • Dates;
  • Spelling;
  • Capitalization;
  • Punctuation;
  • Colors;
  • Fonts;
  • Quantities;
  • Design instructions;
  • Shipping and event dates.

We may contact you if information appears incomplete or unclear. A delay in your response may delay production or shipment.

Unless a product page expressly promises a proof, mockup, or approval step, we are not required to provide one before production.

Where a proof is provided, production may begin after approval or after the approval deadline stated in our communication. Changes requested after approval may require an additional charge or new order.

5. Customer-Submitted Content

When you submit names, wording, photographs, logos, artwork, or other content for personalization, you represent that:

  • You own the content or have permission to use it;
  • Our use of the content to produce your order will not violate another person’s rights;
  • The content is lawful and does not infringe intellectual property, privacy, publicity, or other rights.

You grant us a limited license to use submitted content only as reasonably necessary to prepare, produce, fulfill, support, and document your order.

We will not use private customer photographs or personalization information in public marketing without permission, except where information has been independently made public by the customer or where disclosure is required by law.

We may decline content that is unlawful, abusive, threatening, hateful, discriminatory, obscene, infringing, misleading, or otherwise inappropriate.

6. Orders

An order confirmation acknowledges that we received your order. It does not necessarily mean that we have accepted the order.

We reserve the right, to the extent permitted by law, to reject, limit, or cancel an order because of:

  • Product unavailability;
  • Pricing or description errors;
  • Suspected fraud;
  • Payment issues;
  • Shipping restrictions;
  • Incomplete personalization;
  • Content we cannot legally or technically reproduce;
  • Unusually large quantities;
  • Other reasonable operational concerns.

If we cancel a paid order, we will issue an appropriate refund to the original payment method.

7. Prices and Payments

Prices are displayed in the currency indicated at checkout and may change without notice.

You agree to pay:

  • The product price;
  • Personalization or customization charges;
  • Shipping and handling charges;
  • Applicable sales, use, value-added, or similar taxes;
  • Customs duties, import taxes, or brokerage fees for which the customer is responsible.

Payment must be authorized before production or fulfillment begins.

We may correct pricing or typographical errors before accepting an order. If a correction materially affects an order already placed, we will contact you before proceeding where required.

8. Taxes, Customs, and Import Charges

Applicable taxes may be calculated at checkout based on the order, product, shipping destination, and relevant tax rules.

International customers are responsible for customs duties, import taxes, brokerage charges, and other destination-country fees unless checkout expressly states that such charges have been collected.

We do not control customs inspections or clearance times.

9. Processing and Production

Most products are handmade, personalized, or made to order.

The estimated processing time is shown on the applicable product page, order confirmation, or other customer communication. Processing time refers to the time needed to prepare an order before shipment and does not include carrier transit time.

Processing times may be extended because of:

  • Large or complex orders;
  • Proof or personalization approval delays;
  • Incomplete customer information;
  • Material availability;
  • Holidays or peak wedding seasons;
  • Events outside our reasonable control.

10. Shipping and Delivery

Delivery estimates are not guaranteed unless we expressly state otherwise in writing.

Carrier transit times may be affected by weather, customs, local disruptions, inaccurate addresses, carrier capacity, or other circumstances outside our control.

The customer is responsible for reviewing the shipping address before submitting an order.

Risk of loss and title transfer as provided by applicable law and the shipping terms disclosed at checkout. Nothing in this section limits mandatory consumer protections.

An event or wedding date submitted with an order does not constitute a guaranteed delivery deadline.

11. Returns, Cancellations, and Refunds

Returns, cancellations, exchanges, damaged-item claims, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Personalized and made-to-order products are generally final sale except where defective, damaged, materially incorrect, or otherwise required by applicable law.

12. Intellectual Property

The Site and its content—including product designs, photographs, illustrations, text, logos, graphics, layouts, videos, and branding—are owned by or licensed to Septitri LLC and are protected by applicable intellectual property laws.

You may use the Site only for personal, non-commercial shopping purposes.

You may not, without prior written permission:

  • Copy or reproduce our product photographs;
  • Copy or commercially reproduce our original designs;
  • Scrape or extract Site content;
  • Remove ownership notices;
  • Sell or distribute Site content;
  • Use our name, logo, or branding in a misleading manner;
  • Use Site content to train or develop commercial systems where prohibited by law.

13. Reviews and Feedback

If you submit a public review, testimonial, comment, or non-confidential feedback, you grant us a non-exclusive, royalty-free license to display, reproduce, and use that submission in connection with our business and marketing, subject to applicable law.

We may moderate or remove reviews that contain unlawful content, private information, spam, harassment, or content unrelated to the product or transaction.

We will not materially change the meaning of a review when displaying it.

14. Prohibited Uses

You may not use the Site:

  • For unlawful, fraudulent, deceptive, or abusive purposes;
  • To infringe intellectual property or privacy rights;
  • To transmit malware or harmful code;
  • To interfere with Site security or operation;
  • To scrape or collect data without authorization;
  • To impersonate another person;
  • To submit false payment or account information;
  • To place orders for unauthorized resale where restrictions have been disclosed;
  • To engage in chargeback abuse or payment fraud.

We may suspend access or cancel affected orders when reasonably necessary to protect customers, the Site, or our business.

The Site may use or link to third-party services, apps, payment providers, shipping carriers, or websites.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, policies, availability, or acts, except to the extent required by law.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as available” basis.

We do not guarantee that:

  • The Site will always be uninterrupted or error-free;
  • Product images will appear identical on every device;
  • Carrier delivery estimates will always be met;
  • Third-party services will always be available.

This disclaimer does not exclude warranties or consumer rights that cannot lawfully be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Septitri LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Site or purchase of products.

Where liability cannot be excluded, our total liability relating to a particular order will not exceed the amount paid for that order, except where applicable law requires otherwise.

Nothing in these Terms limits liability for fraud, willful misconduct, personal injury caused by negligence, or any other liability that cannot legally be limited.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold Septitri LLC harmless from third-party claims arising from:

  • Content or materials you submit without proper authorization;
  • Your unlawful use of the Site;
  • Your infringement of another party’s rights;
  • Your material violation of these Terms.

This section does not apply where prohibited by consumer protection law.

19. Privacy

Our collection and use of personal information are described in our Privacy Policy.

20. Governing Law

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be enforced to the greatest extent permitted by law.

22. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

23. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and Septitri LLC concerning your use of the Site and purchase of products, except for any separate written agreement signed by us.

24. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Site with a revised “Last updated” date.

Changes apply prospectively unless otherwise required by law.
